Auvibel

  Definition :

Auvibel is a company that represents a number of companies managing copyright fees. Auvibel was granted accreditation by the Royal Decree issued on 17th October 1995. The company’s aim is to collect and redistribute fees owed for the private reproduction of works and performances by authors, composer-performers or the executives and producers of audio recordings and audiovisual works.

The Act designates the devices and media that are liable to pay for private copies, such as "all media that can be used for the reproduction of audio and audiovisual works and the devices that make such reproduction possible."

Method of invoicing:

Passing on the fee through invoices: Importers and manufacturers pay Auvibel the fee when any appliance or medium of this type is placed on the market in Belgium. Each link in the commercial chain, such as WASLET, invoices the net amount of the fee separately from the selling price. In the end, it is only the end-user who pays the private copying fee.

Products subject to Auvibel payments: The website at www.auvibel.be provides a list of the devices and media that are required to pay the private copying fee, as well as the charges themselves. A list of items not subject to this fee is also available.
Example of items distributed by WASLET:
   - subject to the Auvibel fee: Digital media: CD-R, CD-RW
   - not subject: CD recorder (when a computer component)

The amount of the fee is equivalent to:
   - for media: a charge based on the capacity in minutes of the medium
     (e.g. digital media: €0.10/hour)
   - for playing devices: a percentage of the price of the device

VAT: The rate of VAT that applies to the Auvibel fee is the same as for the product to which it relates.

Stating the Auvibel fee: WASLET invoices state the Auvibel fee separately from the items in question by way of a specific invoicing code (WAS40 - Auvibel Fee)

Reprobel

  Definition :

Reprobel was created on 27th June 1994 and is a cooperative that represents fifteen Belgian copyright management companies (writers, playwrights, composers, journalists, photographers, illustrators, authors of scientific or educational works) and the publishers (of books, newspapers, periodicals, music scores) involved. Reprobel’s aim is to collect and redistribute to the rightful beneficiaries, all fees paid on works recorded on graphics or analogue media for the purpose of making copies for private or educational use.

The payments made to authors and publishers are financed by a fixed fee (paid at the time of purchasing the device) and by a proportionate fee that is calculated as a function of the number of copies made by the user (see the Reprobel website for a more detailed explanation).

The devices covered by this fee: photocopiers, fax machines, scanners, duplicators and office offset machines where the maximum paper size does not exceed A3.
